1. Eligibility

4.3 Availability. All products and offers are subject to availability. We reserve the right to limit quantities, discontinue products, or impose purchase limits (including for suspected resellers) at our sole discretion.

4.5 Typographical errors. In the event a product is listed at an incorrect price or with incorrect information due to error, we reserve the right to cancel any orders placed for the product, whether or not the order has been confirmed.

5. Orders, Payment & Billing

5.1 Placing an order. By placing an order through the Site, you are offering to purchase a product subject to these Terms. We may accept or reject your order at our discretion, including for reasons such as suspected fraud, regulatory restrictions, or product unavailability.

5.2 Order confirmation. After you place an order, you may receive an order confirmation email. This confirmation acknowledges that we have received your order but does not guarantee acceptance. A contract is formed only when we ship your order and send a shipping confirmation.

5.3 Payment methods. We accept payment methods as displayed at checkout (for example, credit/debit card, digital wallets, or other providers). You authorize us (and our third-party payment processors) to charge the total amount of your order, including taxes, shipping (if any), and applicable fees, to your selected payment method.

5.4 Taxes and duties. You are responsible for all applicable sales, use, VAT, GST, import duties, customs fees, and other taxes associated with your purchase. Where required, we will collect applicable taxes at checkout.

5.5 Order changes and cancellations. Once an order has been submitted, we may not be able to modify or cancel it. If you need to request a change, please contact us as soon as possible at hello@tannedkings.com. We do not guarantee that any change or cancellation request can be accommodated.

6. Subscription Program & Auto-Renewals

6.1 Subscription overview. Certain products may be offered on a subscription or "auto-replenish" basis (for example, orders set to auto-replenish approximately every 30 days). By enrolling in a subscription, you agree to receive recurring shipments and be charged automatically at the interval shown at checkout until you cancel.

6.2 Recurring billing authorization. By starting a subscription, you authorize us (and our payment processors) to automatically charge your chosen payment method in the recurring amount shown at checkout (plus applicable taxes and fees) at each renewal date, without further action by you, until you cancel.

6.3 Changes to subscription terms. We may change subscription pricing, frequency, or available products from time to time. If we increase the price or make a material change, we will give you notice (for example, via email or on the Site). Your continued subscription after notice constitutes your acceptance of the changes. If you do not agree, you must cancel before the next billing date.

6.4 Managing or canceling your subscription. You may manage or cancel your subscription at any time before your next scheduled renewal by:

• Logging into your account (if available) and adjusting your subscription settings; or
• Contacting us at hello@tannedkings.com with reasonable notice before your next billing date.

6.5 Failed payments. If we cannot charge your payment method, we may attempt to reprocess the payment or contact you to update your information. We may suspend or cancel shipments until payment is successfully processed.

7. Shipping, Delivery & Risk of Loss

7.1 Shipping. We currently offer shipping options as detailed on our Shipping & Returns section of the Site (for example, free shipping on orders, processing within 1–2 business days, and estimated delivery within 3–5 business days in certain regions). These timeframes are estimates only and are not guaranteed.

7.2 Risk of loss. Risk of loss and title for products pass to you upon our delivery of the products to the carrier. We are not responsible for delays, loss, or damage in transit caused by the carrier or circumstances beyond our control.

7.3 Delivery issues. If your package is lost, stolen, or damaged in transit, please contact us and/or the carrier promptly. We may, at our discretion, help facilitate a claim with the carrier but do not guarantee replacement or refund outside our stated policies.

8. Returns, Refunds & 30-Day Guarantee

8.1 30-day money-back guarantee. We may offer a 30-day money-back guarantee as described on the Site, such as a full refund if you do not see a noticeable tan or improvement in your skin within 30 days, subject to the conditions below and any additional terms stated in our Shipping & Returns section.

8.2 Eligibility. To be eligible for a refund under the guarantee or other return policy, you may be required to:

• Contact us within the stated time period (for example, within 30 days of delivery);
• Return the product(s) (opened or unopened as specified in the policy);
• Provide proof of purchase and any other information we reasonably request.

8.3 How to initiate a return. To start a return, contact us at hello@tannedkings.com and follow the instructions provided. Returns sent without prior authorization may not be processed.

8.4 Refund method. Approved refunds are typically issued to the original payment method used at checkout. Timing of the refund posting may vary depending on your bank or payment provider.

8.5 Exclusions. We reserve the right to deny any refund or return if we suspect abuse of our policies, fraud, or other improper activity.

9. Accounts & Security

9.1 Account creation. You may be able to create an account on the Site. You agree to provide accurate, current, and complete information and to update it as needed.

9.2 Account security. You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access or use.

9.3 Termination of accounts. We may suspend or terminate your account or access to the Site at any time, with or without notice, for any reason, including violation of these Terms or suspected fraudulent activity.

10. User Content (Reviews, Comments & Submissions)

10.1 User content. The Site may allow you to submit reviews, comments, photos, or other content ("User Content"). You are solely responsible for your User Content.

10.2 License to us. By submitting User Content, you grant Kings Tan Drops a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform such User Content in any media now known or hereafter developed, for any lawful purpose, including marketing and advertising.

10.3 Your representations. You represent and warrant that:

• You own or otherwise control all rights in and to the User Content;
• Your User Content is accurate and not misleading;
• Your User Content does not violate any law or infringe any third-party rights.

10.4 Our rights. We may, but are not obligated to, monitor, edit, or remove User Content at our sole discretion.

11. Promotions, Discounts & Offers

11.1 Promotional offers. From time to time, we may run promotions, discounts, Black Friday sales, free gifts, or other offers. The terms and conditions of any promotion will be stated on the Site or in marketing materials.

11.2 Non-combination. Unless expressly stated, promotions or discount codes cannot be combined with other offers or applied to prior purchases.

11.3 Changes and expiration. We may modify or cancel any promotion at any time without notice, including due to misuse or error.

12. Intellectual Property

12.1 Ownership. The Site and all content on it, including text, graphics, logos, icons, images, videos, audio, software, and the overall design and layout, are owned by or licensed to Kings Tan Drops and are protected by copyright, trademark, and other intellectual property laws.

12.2 Trademarks. All trademarks, trade names, logos, brand names, and trade dress used on the Site (including "Kings Tan Drops", "The World's First Drinkable Tan", and any related branding) are the property of Kings Tan Drops or its licensors. You must not use any of these without our prior written consent.

12.3 Limited license. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Site for your personal, non-commercial use only.

12.4 Restrictions. You may not:

• Copy, reproduce, distribute, modify, or create derivative works from the Site or its content;
• Use any data mining, robots, or similar data gathering or extraction methods;
• Frame or mirror any part of the Site without our express written consent.

13. Third-Party Links & Services

13.1 Third-party links. The Site may contain links to third-party websites or services that are not owned or controlled by Kings Tan Drops. These links are provided solely as a convenience.

13.2 No endorsement. We do not endorse or assume responsibility for any third-party content, products, services, or websites. Your use of such sites is at your own risk and subject to the terms and policies of those third parties.

13.3 Third-party payment and analytics providers. We may use third-party payment processors, analytics tools, and other service providers. Your interactions with them are governed by their own terms and privacy practices.

14. Prohibited Uses

You agree not to use the Site or Services:

We reserve the right to investigate and take appropriate action (including blocking access or contacting law enforcement) for any suspected misuse.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, OUR PRODUCTS, AND ALL CONTENT AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, KINGS TAN DROPS DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE OR PRODUCTS WILL MEET YOUR REQUIREMENTS, PROVIDE ANY SPECIFIC HEALTH OR AESTHETIC RESULTS, OR BE FREE FROM DEFECTS, ERRORS, OR INTERRUPTIONS.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KINGS TAN DROPS, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, OUR PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, OUR PRODUCTS, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

17. Indemnification

You agree to indemnify, defend, and hold harmless Kings Tan Drops, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Site or our products;
• Your violation of these Terms;
• Your violation of any law or the rights of any third party;
• Your User Content.

18. Governing Law & Dispute Resolution

18.1 Governing law. These Terms and any disputes arising out of or related to your use of the Site or our products shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict-of-law principles.

18.2 Informal resolution. Before filing any claim, you agree to first contact us at hello@tannedkings.com and attempt to resolve the dispute informally.

18.3 Venue. Subject to any mandatory consumer rights in your jurisdiction, you agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the courts of San Francisco, California, United States, and you consent to the personal jurisdiction of such courts.

If you plan to use an arbitration clause or class action waiver, you should have a lawyer draft or approve that language to ensure it complies with local law.

19. Electronic Communications

By using the Site or sending us emails, you consent to receive communications from us electronically (for example, via email, notices on the Site, or other digital means). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

If you subscribe to our marketing emails or SMS (if available), you can opt out at any time by following the unsubscribe instructions in the message.

20. Termination

We may, at any time and without prior notice, suspend or terminate your access to the Site and/or Services, or cancel your orders (with appropriate refunds where applicable), if we believe you have violated these Terms, engaged in fraudulent behavior, or if required by law.

You may stop using the Site at any time. Any provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) shall survive.

21. Miscellaneous

21.1 Entire agreement. These Terms, together with our Privacy Policy and any other policies or terms referenced herein, constitute the entire agreement between you and Kings Tan Drops regarding your use of the Site and our products.

21.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be deemed severed and the remaining provisions will remain in full force and effect.

21.3 No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

21.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time.
